*The Real Housewives of Atlanta *alum Kim Zolciak’s 15-year-old son asked to be tried as a juvenile days after being indicted on seven felony counts.
Multiple outlets have reported that Kroy “K.J.” Biermann Jr.’s legal team filed a motion in Georgia’s Fulton County Court on Tuesday asking that his case be transferred “to juvenile court and for confidentiality proceedings.” Being tried as a juvenile could result in lesser charges if K.J. is convicted.
*Page Six** *was first to report the news on Wednesday with a statement from K.J.’s laywer, Jason Sheffield. The attorney revealed that they expect to “enter a not guilty plea to all charges” during an upcoming arraignment hearing set for Oct. 14. Sheffield also noted that K.J. should be tried “as a juvenile,” explaining his decision to file the recent motion.
“It is difficult to comprehend that a 14- or 15-year-old child can be held in detention for a month or longer simply waiting for a bond hearing,” Sheffield told *Page Six*. “But that detention is a direct consequence of the detective’s decision to arrest him on charges of this magnitude.”

EW’s sister site PEOPLE confirmed on Sept. 3 that K.J. — Zolciak’s eldest son with estranged husband Kroy Biermann — is facing charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under the age of 16 following an alleged incident that took place this past April.
Sheffield addressed the indictment in a statement to EW last week.
“I respect the difficult responsibilities carried by prosecutors and victim advocates,” he said at the time. “Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues.”
Sheffield continued, “There are two children at the center of this case. K.J. was 14 years old when these events allegedly occurred. He was arrested at 15 and, less than three weeks later, indicted on charges carrying extraordinary consequences. But adult consequences do not transform a child into an adult. The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe.”
K.J. was arrested on Aug. 17 after being accused of a sexual assault incident that allegedly took place in the changing room at a Life Time Fitness located in Alpharetta, Ga. A police report obtained by EW claims that the alleged female victim told K.J. “no” multiple times but he allegedly attempted to force himself on her. The report claims that K.J. “tried multiple times to have sexual intercourse with her by trying to pull down her pants.”

Sheffield previously told EW that arrest and indictment could not “tell us the whole truth of a case,” stating that only “one side” has been told.
“The accused has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding. That is not a criticism of the process; it is simply where we are,” he added. “Without DNA evidence, the case remains one of ‘she said, he said’ and the credibility of the accuser. The evidence that I have gathered will prove, at the appropriate time and place, that K.J. Biermann is not guilty of these horrific allegations. God willing, that place will be juvenile court, where the lives of these young people can be respected and honored.”

The statement concluded, “Until then, these are children whose lives should not become something for adults to ‘thumbs up’ or ‘heart’ on social media. We should not cheer against children.”
